Subclass 189

Subclass 189 is a permanent independent visa which allows you to live anywhere in Australia after grant. There are two streams in Subclass 189 visa.

Points Tested stream

Under the points tested stream, you are required to pass the minimum points score set by the Department of Home Affairs. This visa allows you to live and study anywhere in Australia after the grant. Following are the basic requirements for this stream.

You must

  • have an occupation on the relevant skilled occupation list (follow the link 'Skilled occupation list' below for a list of skilled occupations)

  • have a positive skills assessment from a relevant skills assessing body

  • be under 45 years of age

  • be invited by the Department to apply for this visa

  • satisfy the points test (follow the link 'Points table' below for calculating your points)

Skilled Independent visa

Hong Kong stream

The Hong Kong stream allows the eligible Hong Kong or British National (Overseas) passport holders to live and work in Australia permanently. There are the following basic requirements for this stream.

You must

  • hold a Hong Kong or British National (Overseas) passport at the time of application

  • have lived in Australia for 4 years on an eligible visa subclass 457, 482 or 485

  • have functional English at the time decision is made on the application (follow the link 'Functional English' below for a definition of functional English)

Subclass 190

Subclass 190 is a State/Territory nominated visa that allows you to migration to Australia permanently. After initially living in the nominating State/Territory, you can live, work and study anywhere in Australia. Just like subclass 189, it is a points tested visa where you need to score the passing points to be eligible to apply.

You must

  • have an occupation on the relevant skilled occupation list (follow the link 'Skilled occupation list' below for a list of skilled occupations)

  • have a positive skills assessment from a relevant skills assessing body

  • be under 45 years of age

  • be nominated by a State or Territory

  • be invited by the Department to apply for this visa

  • score 65 points or more on the points test (follow the link 'Points table' below for calculating your points)

Skilled Nominated visa

Skilled Work Regional (Provisional) visa

Subclass 491 is a point based skilled regional visa nominated by a State or Territory to live and work in regional Australia. It is a provisional visa with a pathway to permanent residency after living and working in a regional area for 3 years. The requirements for this visa are very similar to subclass 190 except that it is a provisional visa, and you are given higher points for the State/Territory nomination.

Subclass 491

You must

  • have a positive skills assessment from a relevant skills assessing authority

  • be under 45 years of age

  • be nominated by a State or Territory

  • be invited by the Department to apply for this visa

Subclass 191

Subclass 191 is a permanent residency pathway for the Subclass 491 and 494 visa holders who have lived and worked in regional Australia for 3 years. Following are some basic requirements for this visa. There are two streams in this visa, Regional Provisional stream and Hong Kong stream.

Permanent Residence (Skilled Regional) visa

Regional Provisional stream

You must

  • have worked and lived in a designated regional area on a Subclass 491 or 494 visa (eligible visa) for at least 3 years

  • provide notices of assessments from the Australian Taxation Office for 3 income years

  • have complied with the conditions of your eligible visa

Hong Kong stream

You must

Temporary Skill Shortage visa

This is a temporary visa for skilled workers who are nominated by an approved work sponsor for a position. There are 3 streams in this visa, short-term stream, medium term stream, and labor agreement stream.

Medium-term stream

You must

  • have your occupation on the Medium and Long-term Skilled Occupation List

  • have 2 years' work experience in the nominated occupation

  • be nominated by an approved work sponsor to work in the nominated occupation

  • have the skills, qualifications and work experience required for performing the nominated occupation

  • work only for the nominating employer business or associate entity unless exempt

  • have minimum level of English language required for the nominated occupation

  • have health insurance for the duration of your stay in Australia on this visa

Labour Agreement stream

You must

  • be sponsored by an Australian employer under a labour agreement

  • have 2 years' work experience in the nominated occupation unless otherwise specified in the labour agreement

Subclass 186

Direct Entry stream

You must

  • must be nominated by an Australian employer

  • have an occupation on the relevant skilled occupation list

  • have at least competent English

  • have a positive skills assessment from a relevant skills assessing authority (unless you are an exempt person)

  • have 3 years' work experience (unless you are an exempt person)

Subclass 186 is a permanent visa that allows the skilled workers who are nominated by their employers to live and work permanently in Australia. There are 3 streams under this visa, Direct Entry stream, Labour Agreement stream and Temporary Residence Transition stream

Employer Nomination Scheme visa

Labour Agreement stream

You must

  • be working or will be working under a labour agreement for your employer

  • have suitable experience and English language skills as may be decided under the labour agreement

  • be nominated by an Australian employer who is party to a labour agreement

  • be under the age of 45

  • hold a sublcass 457 or TSS visa under a labour agreement

Temporary Residence Transition stream

You must

  • be nominated by the employer who nominated you for your TSS visa

  • hold a subclass 457 or subclass 482 visa in any stream on the basis of meeting the primary criteria

  • provide skills assessment if requested by the Department to prove that you have the required skills for the job

  • be under the age of 45

  • have at least competent English

Subclass 494

Subclass 494 is a visa for skilled workers who are sponsored by their employers to live and work in a designated regional area. It also provides a pathway to permanent residency if eligible. It has two streams, Employer Sponsored stream and Labour Agreement stream. Both the streams have different requirements as summarized below.

Skilled Employer Sponsored Regional visa

Employer Sponsored stream

You must

  • be nominated by your employer (the employer must be approved work sponsor)

  • have an occupation on the relevant skilled occupation list

  • have at least 3 years work experience in your occupation

  • be under the age of 45 unless exempt

  • work only for your employer or an associated entity

  • have a positive skills assessment assessed by the relevant assessing authority unless exempt

  • have at least competent English unless exempt

  • be working under a labour agreement

  • have the required proficiency level of English as specified in the labour agreement
