Subclass 802

Subclass 802 visa allows the dependent child of an Australian citizen, permanent resident or eligible New Zealand citizen parent to move to Australia permanently.

Subclass 802 visa requirements

You must

  • be a dependent child of a parent who is an Australian citizen, permanent resident or eligible New Zealand citizen

  • be under 18 or a full-time student if over 18 and under 25 or over 18 and unable to work due to a disability

  • be single

  • be dependent on the parent

  • be in Australia when the visa application is lodged

  • meet the health requirement for the visa

Subclass 101

Subclass 802 visa requirements

You must

  • be a dependent child of the parent who is an Australian citizen, permanent resident or eligible New Zealand citizen

  • be under 18 or a full-time student if over 18 and under 25 or over 18 and unable to work due to a disability

  • be single

  • be dependent on the parent

  • be outside Australia when the visa application is lodged

  • meet the health requirement for the visa

Subclass 101 is the offshore equivalent of Subclass 802. This visa allows a dependent child (who is outside Australia) of Australian citizen, permanent resident or eligible New Zealand citizen parent to move to Australia permanently.

Health requirements

Australia maintains a high standard of public health and to maintain this standard, most of the visa applicants are required to meet the minimum health requirement before the visa can be granted.

A Medical Officer of the Commonwealth (MOC) assess your medical examination and will advise the Department if you have a medical condition that will

  • threaten public health

  • cause a significant healthcare and community services cost to the Australian community

  • limit the access of Australian citizens and permanent residents to healthcare and community services

If you have such a condition, Significant Cost Threshold (SCT) is used to determine whether you meet the health requirement or not. The current SCT is $86,000. The health care and community service cost your condition may cause will depend on the type and severity of the condition.

What this means is that if you have a condition that may cause a health care and community cost to Australia which is more than the SCT i.e., $86,000, you will not meet the health requirement.

Health Waver

A health waver is available for Subclass 802 Child visa. If you do not meet the health requirement, the visa processing officer will advise so and will seek more information on why a health waver should be given. The Department will consider the factors such as

  • whether you or your family can reduce the potential cost of the condition and reliance on the health care and community services

  • any compassionate and compelling circumstances in favor of a health waver
